Terms and Conditions
Updated: 17 October 2026. English translation of the German original. In case of discrepancies, the German version prevails.
1. Scope
These Terms and Conditions apply to contracts between David Sigg Fotografie (the provider) and private or business customers for photo booth and accessory hire, event photography and agreed image preparation. Different payment arrangements are set out in section 4.
2. Services and subject of the contract
The provider hires out photo booths and accessories, including MemoryBook, live slideshow and CI props, and offers event photography separately or together with a booth. Personal delivery, setup, instructions and collection are agreed individually. Personalised items that cannot be reused become the customer’s property. The exact services are defined in the offer or booking confirmation.
3. Booking and contract formation
An enquiry is non-binding. The first email only confirms receipt. After personal review, the provider releases an offer with a personal booking link. The date is provisionally reserved for five days from release and is freed again if no booking is made. A contract is formed only when the customer accepts the terms and clicks “Book now – binding”. Individual offers may also be accepted by a separate written agreement. For booth-only bookings without on-site support, photography or custom-made items and with a free date, the customer may book directly: the contract is formed when the customer accepts the terms in the enquiry form and clicks “Book now”; the booking confirmation follows by email. The price shown in the packages and options published on the website applies. Obviously incorrect prices, for example due to technical errors or manipulation, do not bind the provider. There is no general statutory right of withdrawal; the cancellation terms in section 8 apply. Changes and additions must be recorded in text form.
If there is no fixed event date, a non-binding indicative quote may be prepared. It is a price estimate only, does not reserve a date and does not form a contract. The five-day reservation begins only after a specific date has been provided, availability checked and the offer released.
The quick availability check is also non-binding and does not reserve a date. All agreed days must be available for consecutive or separate event days. Infinity Booth and Lounge Edition are two configurations of the same device and cannot be hired simultaneously. Magic Mirror and Compact Edition can already be booked for events from 1 February 2027; earlier events are not possible.
4. Prices, payment and travel charges
All prices are in CHF. The provider is not registered for VAT (annual turnover below CHF 100,000), so no VAT is charged or shown. Payment is due within 10 days of the invoice date, both for a private deposit (and no later than one day before the event) and for the final invoice.
Private customers pay a deposit of 25% of the total through Stripe on their personal booking page or the provided checkout link. Depending on device and availability, TWINT, card, Apple Pay or Google Pay may be available. The deposit is credited against the total. By agreement, the balance may be paid in cash, by TWINT or card (SumUp) on site, or by bank transfer using an invoice with a Swiss QR payment section issued by the provider. Online payment of the final invoice is available only if expressly offered by the provider.
Business customers pay no deposit and are not directed to online payment. They receive an invoice for the full amount after the event and pay by bank transfer according to the invoice details.
Travel is calculated from Pratteln BL. Every package includes 30 km of the one-way distance. Additional distance costs CHF 0.50 per extra kilometre for the four journeys needed for delivery/setup and collection/dismantling, including each return journey. The calculation uses the venue postcode and is stated in the offer.
5. Hire duration and multi-day bookings
Prices cover one event day or evening, including the time required for delivery, setup, collection and return transport. The booth may therefore remain at the venue for more than one calendar day without an additional event-day charge. Earlier delivery or later collection is by agreement and included unless otherwise agreed.
If the booth remains at the same venue without additional transport or rebuilding, the booth price is calculated per event day and the following discount is applied to that hire amount: 2 days 20%, 3 days 25%, 4 days 30%, 5 days 35%, 6 days 40%, and 7 or more days 45%. These discounts exclude extras, travel and photography.
For separate event days requiring delivery, setup and collection each time, day one is charged at the regular booth package price, day two receives 15% off the booth hire amount, and day three onwards 25%. Travel is charged in full for each separate event day. This discount does not apply to extras, support or photography, and cannot be combined with the consecutive-day discount. Recurring series and roadshows receive an individual offer.
6. Accessory terms
- Backdrops: Included (of your choice) in the Premium and Unlimited packages, otherwise available as a paid extra.
- BrandCase: The photo booth is branded according to your individual ideas and wishes; available for Infinity Booth and Lounge Edition.
- Print layout: The standard layout is a plain photo without graphics, frame or text and costs nothing extra. A custom layout based on the print layout gallery costs a one-off CHF 35 unless already included in the booked package. Design is agreed individually; the personal booking link associates the layout selection with the booking.
- Props: Standard props (signs, glasses, wigs, inflatable instruments, hats) are included. Special themed props can be added for a flat fee; the theme must be specified when booking.
- Instant printing: The amount of instant printing depends on the booked package: Basic has no prints, Standard includes 200 prints, Premium 400 prints and Unlimited unlimited prints per event. If more prints are made, up to 50 additional prints are free of charge. Beyond that, the difference to the next print tier is charged according to the price list (200 to 400 prints: CHF 40, 400 to unlimited: CHF 60), at most up to the price for unlimited prints. The printer's counter is authoritative.
- Online gallery: After the event, the images are provided free of charge for one year in a password-protected online gallery.
- Photo booth game: Included in the Unlimited package, otherwise available as a paid extra.
- MemoryBook: The DIY memory book is offered for weddings and birthdays and is included or can be added depending on the package. It is not available for business events (e.g. corporate events, trade fairs). The MemoryBook is not a rental item and may be kept.
- Live slideshow: In the basic option the slideshow is set up on the customer’s own device (TV, screen or projector with HDMI input). A screen or a projector with projection screen can be booked from the provider; transport and set-up are included.
- Instant camera guestbook: Instant cameras, film and a MemoryBook as an add-on to the photo booth or as a separate product by post (shipping and return shipping included; the return label is enclosed). It is confirmed on request only and with at least 10 days' notice. The MemoryBook is the customer's to keep; cameras and accessories must be posted back no later than the second working day after the event or returned with the photo booth. Lost or damaged cameras are charged at CHF 90 each. Unused film is not refunded. As a separate product by post, private customers pay the full amount when booking (instead of a deposit); the set is shipped once payment is received so that it arrives a few days before the event. Business customers receive an invoice as usual.
- Event video: Packages with a fixed maximum filming time; additional filming time is charged at CHF 150 per hour or part thereof. If photography and video are booked together, the provider deploys a second person (second shooter). Music is used under licence; editing, shot selection and design are at the provider's discretion, one round of corrections is included. Raw footage is not part of the delivery. The delivery date is confirmed in the quote. Event video is confirmed on request only.
- On-site support: Whether on-site support by the provider is required depends on the risk of the event. It is mandatory (CHF 50 per hour) at open public events with an anonymous crowd, a bar or operation late into the night, e.g. club nights, parties with free entry, town and village festivals, festivals, open-air events or carnival. At trade fair and corporate stands, the customer’s stand staff may look after the booth themselves, provided they are briefed by the provider at set-up, the customer names a responsible contact person and the booth is secured outside opening hours; in that case the customer is liable for damage and loss under section 9. For private celebrations (e.g. weddings, birthdays, club parties) and closed corporate events, support is optional and can be added at any time. In case of doubt, the provider assesses the event together with the customer in advance.
Unlimited package: The Unlimited package already includes all accessories – a backdrop of choice, BrandCase (for Infinity Booth and Lounge Edition), custom print layout, live slideshow, MemoryBook (for weddings and birthdays), photo booth game, special themed props and unlimited prints. Photography, image editing, on-site support, event video, the instant camera guestbook and any extra travel distance are not included merely by choosing Unlimited. The services listed in the offer are decisive.
7. Event photography and combination discounts
Event photography may be requested alone or with a booth and costs CHF 150 per hour. Image selection, preparation and delivery have a mandatory minimum allocation based on photography duration: under 3 hours, 0.5 hours; from 3 up to and including 8 hours, 1 hour; over 8 hours, 2 hours. If optional image editing is selected, as many additional editing hours as photography hours are added. Image preparation and editing cost CHF 80 per hour.
Photography and on-site support can be entered in 15-minute increments as a duration or start/end times, including overnight. The resulting duration determines the calculation. No start/end times are entered for image editing; its allocation follows the formula above. Duration, services and price are stated in the offer.
When photography and a booth are booked together, two discounts apply. The booth hire amount, after any multi-day discount, receives 10% off for up to and including 2 photography hours, 15% for over 2 up to and including 4 hours, and 20% for over 4 hours. Photography services, including applicable image preparation/editing, receive no discount under 6 hours, 10% from 6 to under 9 hours, and 20% from 9 hours. No combination discount applies without a booth. Extras, on-site support and travel are excluded.
8. Cancellation and withdrawal
Private customers pay a 25% deposit, credited in full against the total. Business customers do not pay a deposit and receive an invoice after the event. The remaining amount is invoiced before or after the event as agreed.
Cancellation charges: 30 days or more before the event: free cancellation and deposit refund. 29–14 days: 50% of the deposit is retained and the rest refunded. 13–8 days: the full deposit is retained. From 7 days to 48 hours before the event: 50% of the total is due. Less than 48 hours before the event or no-show: 100% of the total is due.
Payments already made are credited against cancellation charges. For business customers without a deposit, cancellation costs are 12.5% of the total at 29–14 days and 25% at 13–8 days; the other tiers apply equally. These amounts are invoiced.
Production costs already incurred for custom modules such as BrandCase or CI props are payable in addition, regardless of cancellation date.
9. Faults, failure and liability
The provider supplies tested, working equipment. In the event of a fault, the provider seeks to offer telephone support or replacement where possible. If a technical fault not caused by the customer or guests prevents use, the hire amount is refunded proportionally or fully depending on the failure. Further liability, especially for lost profits or consequential damage, is excluded to the extent permitted by law. Liability for intent or gross negligence and mandatory statutory claims remain unaffected.
The customer is liable for damage caused by improper use, incorrect operation, force, liquids, falls, manipulation of hardware/software or guests. This includes repair or replacement at replacement value, lost hire income if the device is unavailable for subsequent bookings, and additional service or technical work needed to restore operation.
Manipulating the software, operating system, camera, network or control settings is prohibited. Faults caused by such changes are treated as customer-caused damage. Normal wear and ordinary signs of use are not damage.
Photos are stored on the booth and then in the online gallery. The provider is liable for the loss of some or all photos due to technical faults (e.g. storage errors) only in cases of intent or gross negligence. Customers are advised to download the photos from the online gallery promptly and keep their own copy.
10. Data protection
The Privacy Policy applies. Personal data is processed in particular for enquiries, contracts, invoicing, communication and website security. Further details are provided in the Privacy Policy.
11. Image rights and 50% advertising promotion
Copyright in photographs created by the provider remains with the provider. The agreed usage scope is recorded in the offer. Providing a gallery does not mean consent to advertising publication. Advertising use of booth or event photos requires separate, explicit consent from identifiable individuals; the organiser’s approval does not replace it. For minors, consent from the legal representative must be obtained.
The customer informs guests appropriately that a photo booth is in use at the event and that the photos will be provided in a password-protected online gallery afterwards.
The 50% advertising promotion gives the customer 50% off the total booking in exchange for explicit agreement that the provider may record the booth in use and interacting guests during the event and use the recordings for the provider’s own advertising, including the website, social media and paid advertisements. It applies only to bookings with an event date on or before 31 March 2027 and cannot be combined with other promotions, discount codes or vouchers.
12. Customer obligations
The customer provides a level, firm setup area at the venue (about 1 × 1 m for the booth alone, about 3 × 4 m with backdrop and props table), a power socket (230 V) nearby and clear access for delivery, setup and collection. Outdoors, the booth must stand under a roof, protected from rain, moisture and direct sun. The customer informs the provider in good time of special circumstances (e.g. stairs without a lift, access restrictions, parking). Extra effort or damage resulting from a lack of cooperation is borne by the customer.
13. Rescheduling
The event date can be moved once, provided the new date is available and falls within 12 months of the original date. Payments already made are credited to the new date. What applies depends on when the request is received in writing:
- Up to 30 days before the event: free of charge.
- 29 to 8 days before the event: a rebooking fee of CHF 100. If the original date can be hired out to someone else, the fee is waived.
- From 7 days before the event: treated as a cancellation under section 8.
Further changes, or a new date more than 12 months after the original date, count as a cancellation under section 8 unless agreed otherwise.
14. Provider unable to attend
If the provider cannot attend a booked date due to illness, accident, vehicle breakdown, force majeure or other reasons beyond the provider’s control, the provider informs the customer immediately and seeks an equivalent replacement (e.g. another booth or a stand-in). If no replacement is possible or the customer declines it, all payments already made are refunded in full. Further claims are excluded to the extent permitted by law; liability for intent and gross negligence remains unaffected.
15. Governing law and jurisdiction
Swiss law applies. The place of jurisdiction is Pratteln BL to the extent permitted by law.
